1. Agreement to Terms
By accessing or using VibeShot ("the Service") at vibeshot.me, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. The Service is operated by VibeShot (vibeshot.me) and provides AI-powered photo transformation packages sold online.
2. Intellectual Property
Unless otherwise indicated, the site, branding, software, and original content are owned by VibeShot and protected by applicable intellectual property laws.
Your Content
You retain rights to photos you upload. You grant VibeShot a limited license to store, reproduce, and process your uploads solely to provide the Service, including AI generation and order fulfillment. We do not claim ownership of your uploads or generated outputs. Upon delivery, you receive the usage rights described below for your purchased category.
3. Usage Rights for AI-Generated Photos
Choose Small ($19), Medium ($29), or Large ($49). Each tier includes finished outputs, look/style access, and retry tokens (3, 6, or 12). You choose Professional, Dating/Social, or Fun on the next screen before selecting styles.
Usage rights depend on the outcome category you select:
Professional
Commercial and professional use for LinkedIn, resumes, business profiles, publications, and corporate materials, subject to these Terms.
Dating/Social
Personal profile use for dating apps, social profiles, and personal profile updates. Not licensed for commercial advertising without a separate agreement.
Fun
Personal, non-commercial creative use for avatars, social profiles, and original portrait sets. Not licensed for commercial advertising without a separate agreement.
4. User Representations
By using the Service, you represent and warrant that:
- ✓You are at least 18 years old, or you have parental or guardian consent to use the Service.
- ✓You have legal capacity to agree to these Terms.
- ✓You will only upload photos of yourself or individuals who have given explicit consent.
- ✓You will not upload misleading, deceptive, harmful, or unlawful content.
- ✓You will not attempt to access the Service through automated or non-human means except as we expressly allow.
- ✓Your use of the Service will comply with applicable law.
5. Purchases and Refunds
VibeShot sells digital photo packages processed after checkout. Payments are handled by Stripe. Prices and entitlements are shown at checkout and resolved server-side.
Delivery is through your order dashboard and email when your pack is ready. Retry tokens are included by tier (3 for Small, 6 for Medium, 12 for Large).
Digital sales are generally final once generated outputs for your order are delivered or made available in your dashboard. If delivery fails or results are materially different from the purchased entitlements, contact support@vibeshot.me within 7 days of purchase.
Satisfaction Support
Use included retry tokens first. Contact support within 7 days if delivery fails or results are materially off from the selected package promise.
6. Limitation of Liability
To the maximum extent permitted by the laws of New South Wales, Australia, VibeShot, its operators, affiliates, directors, employees, and agents will not be liable for indirect, consequential, exemplary, incidental, special, or punitive damages (including loss of profit, loss of data, or other intangible losses) arising from or relating to your use of the Service.
Liability cap
If you have not completed a paid order with VibeShot, we owe you no monetary liability for browsing the site, creating an account, uploading unpaid photos, or using free features of the Service.
If you have completed a paid order, our total aggregate liability to you for any claim relating to that specific order, regardless of the form of action (contract, tort, negligence, strict liability, or otherwise), is strictly limited to the total amount you paid to VibeShot for that order.
You agree this allocation of risk is fair and that you would not use the Service without agreeing to this limitation.
7. AI and Service Disclaimer
VibeShot uses AI to generate portrait-style images from your uploads. Results may vary based on photo quality, lighting, and selected styles. We do not guarantee that outputs will match your expectations, resemble a specific aesthetic, or be suitable for every platform or purpose.
8. Governing Law and Jurisdiction
These policies, your use of the Service, and any dispute arising from them are governed by the laws of New South Wales, Australia. You and VibeShot agree that any legal action must be brought exclusively in the courts of New South Wales, Australia, and you submit to the personal jurisdiction of those courts.
9. Changes and Contact
